Custody and Access are terms used in the Divorce Act. They describe parents’ rights and obligations to spend time with and make decisions about their children.
Closely related, but different, terms are used in the BC Family Law Act (the BC FLA): Guardianship and Parenting Time.
The Ontario Children’s Law Reform Act (the CLRA) uses the terms Custody, Access and Guardianship. The first two terms are analogous to the terms from the Divorce Act. The use of Gaurdianship in the CLRA is not quite the same as Guardianship in the BC FLA though.
